Terms & Conditions and Privacy

These Terms and Conditions form part of Our Agreement. Our Agreement deals with what you must do, what we agree to do, how we deal with each other’s “content” and “intellectual property” what you must not do, our liability, your liability, privacy obligations and other matters.

What is “Our Agreement” and who does it cover?

1. We are One Degree Health Pty Ltd ACN 606 235 741.

2. Our Agreement comprises:
(a) these terms and conditions;
(b) the One Degree Health Privacy Policy;
(c) policies, notices and disclaimers displayed elsewhere on the One Degree Health Website or LifeBuddi Mobile Application or Website; and
(d) the Payment Terms.

3. Our Agreement governs our relationship with:
(a) registered participants of LifeBuddi (we call you “Participants”); and
(b) people place an order for any purchase through the LifeBuddi Mobile Application or Website (Purchase Order), or otherwise access or use the LifeBuddi Website (together, we call you “Website Users”).

Our Agreement also governs the relationship between Participants and the companies and brands that sponsor One Degree Health (we call them “Partners”).

4. If you are a Participant you agree to Our Agreement at the time you download the LifeBuddi Mobile Application.

5. If you are not a Participant but you place a Purchase Order or you are otherwise a Website User, you agree to Our Agreement at the time you access and use the LifeBuddi Website (including to place a Purchase Order). You enter into a separate agreement each time this occurs.

6. It is your responsibility to ensure that you understand and agree to Our Agreement. You must read these terms and conditions carefully. Some of the terms used in Our Agreement are defined throughout these terms and conditions or at the end.

7. If you are a Participant, you must read and agree to Our Agreement before you tick the accept box.

8. If you are not a Participant you must read and agree to Our Agreement before you proceed at any time to access and use the LifeBuddi Mobile Application or Website (including to place a Purchase Order).

9. If you do not agree to any term or condition of Our Agreement (including any disclaimer displayed elsewhere or the Payment Terms) you must not continue to:
(a) have an account as a Participant;
(b) place any Purchase Order; or
(c) otherwise access or use LifeBuddi Mobile Application or Website.

How can Our Agreement change?

11. We can change Our Agreement so long as we provide you notice through the One Degree Health Website. You should regularly check the One Degree Health Website for this purpose.

12. We can make changes for legal or administrative reasons upon notice effective immediately. Otherwise, we will give you a minimum of three days notice.

13. If you disagree with any of these changes, you must immediately discontinue being a Participant, placing any Purchase Order, or otherwise accessing and using the LifeBuddi Mobile Application or Website. If you continue to do so this will signify your agreement to the new or amended terms of Our Agreement.

Participants must sign up

14. To be a Participant you must sign up with us. In signing up you must provide us with, amongst other things, a current e-mail address, and your full name.

15. It is your responsibility to act responsibly as a Participant.

16. You must keep your account information up to date with us. We require this to be able to identify you, to contact you as permitted under Our Agreement and for security purposes.

17. You must be at least 15 years old to sign up as a Participant. You must not attempt to do this if you are under 15 years old.

18. If you choose to use a workplace email address for your account or to access the LifeBuddi Mobile Application or Website, you are responsible for ensuring that such use complies with any rules, policies or protocols which apply to the use of the Internet in your workplace.

19. If you allow someone else to use your account, you are liable under Our Agreement for any act or omission by them which may breach Our Agreement.

Your privacy

20. The privacy of all Participants, Mobile Application and Website Users is very important to us. We will only collect, use and disclose your personal information in accordance with our Privacy Policy. You should read the Privacy Policy and make informed decisions about your personal information.

21. You agree that all content and information you share or post on or make available to the LifeBuddi Mobile Application or Website may be publicly viewable.

Communications with you

22. If you are a Participant, you agree that we may contact you through your account details in relation to your participation with LifeBuddi except that we will only communicate with you for marketing purposes, news about LifeBuddi or news about beneficiaries if you opt-in to such communications.

23. If you make a Purchase Order, you agree that we may contact you through your contact details which you provide at the time of registering for LifeBuddi or placing the Purchase Order in relation to your purchase.

24. You agree that our main form of communication with you will be by email. If you provide us with a telephone number, you agree that we may contact you through that number also.

25. You may opt-in to certain communications from us or third parties in relation to marketing, news about LifeBuddi, or other information available from time to time. If you do so, we or third parties may communicate with you in accordance with your opt-in unless you notify us or them otherwise.

Payments you might make

26. If you place any Purchase Order you agree to our Payments Terms at the time of doing so.

27. You must only place a Purchase Order in accordance with Our Agreement (including the Payment Terms).

28. The LifeBuddi Mobile Application and Website is designed for people in Australia.

29. Accessing and using the LifeBuddi Mobile Application and Website from countries where the content is or could be illegal is strictly prohibited.

30. If you are a Participant or access or use the LifeBuddi Mobile Application or Website from a location outside Australia you do so at your own risk and you are solely responsible for, and assume all responsibility for, compliance with local laws.

What we will do

31. We will make the LifeBuddi Mobile Application and Website available in accordance with Our Agreement but do not guarantee any level of or any availability of the LifeBuddi Mobile Application or Website.

32. We will use reasonable endeavours to notify you and any relevant authorities should we be aware of or have a reasonable basis to suspect that the security of your account or any information about you held by us has been compromised or if you may be seriously affected by a breach by another person of Our Agreement with them.

About you sharing your content and intellectual property

33. We understand the importance to you of the content you post on or make available to the LifeBuddi Mobile Application or Website (Your Content). Under Our Agreement, as between us and you, you own Your Content.

34. In order for us to make LifeBuddi available in our desired format and structure and for us to provide the functions we wish on the LifeBuddi Mobile Application and Website, we must be able to use certain types of Your Content in certain ways. Therefore, you give us non-exclusive, transferable, sub-licensable, royalty-free, worldwide license under the intellectual property in Your Content to:
(a) enable you to share Your Content on the LifeBuddi Mobile Application and Website;
(b) share Your Content on the LifeBuddi Mobile Application and Website and through emails or SMS with selected individuals nominated by you;
(c) enable you to access and use the LifeBuddi Mobile Application and Website;
(d) make and distribute marketing material in relation to LifeBuddi which includes Your Content at anytime (including after Our Agreement is terminated);
(e) back up the data on the LifeBuddi Mobile Application and Website;
(f) ensure your compliance with Our Agreement; and
(g) comply with any obligation we have under in relation to One Degree Health, the LifeBuddi Mobile Application and Website and/or Your Content.

35. You provide us with consent under any moral rights you have in Your Content to do any of the above.

36. When you remove Your Content it may persist in backup copies for a reasonable period of time but will not be available to others.

About us sharing our content and intellectual property with you

37. We have worked very hard to develop and build One Degree Health and the LifeBuddi Mobile Application and Website so it can be available and useable by you. You acknowledge and agree that, as between you and us:
(a) we are the owner of copyright and all other intellectual property in any content available or provided through One Degree Health and the LifeBuddi Mobile Application and Website other than Your Content; and
(b) the LifeBuddi Mobile Application and Website Website (and any modifications, adaptations, updates or new versions) is and embodies customised architecture, guided forms, processes, methods, activities, strategies, trade secrets, know how, and techniques and other ideas which are our intellectual property and must only be used by you in accordance with Our Agreement.

38. We give you the following licence in relation to the LifeBuddi Mobile Application and Website but you cannot access, use or exploit the LifeBuddi Mobile Application and Website outside this licence. While you have the right to access and use the LifeBuddi Mobile Application and Website, we authorise and license you on a non-exclusive, non-transferable basis to use the LifeBuddi Mobile Application and Website in accordance with Our Agreement. You are not permitted and have not licence to reproduce, modify or adapt any software on the LifeBuddi Mobile Application and Website. You are not authorised and have no licence to use our registered or unregistered trademarks unless we provide you with express permission in writing to do so.

About other people’s content and intellectual property

39. You must ensure you have all intellectual property rights and any other rights required to the content you post on or make available to the LifeBuddi Mobile Application and Website to enable you to do so.

40. You must not use or exploit other people’s content provided through the LifeBuddi Mobile Application and Website or posted to or made available on the LifeBuddi Mobile Application and Website unless they give you express permission to do so. Things you must do (to keep One Degree Health and the LifeBuddi Mobile Application and Website appropriate and working properly)

41. We want to keep all content and information shared through One Degree Health and on the LifeBuddi Mobile Application and Website appropriate and in compliance with relevant laws and legal obligations and we need to protect the rights and safety of all Participants and Mobile Application and Website Users. We also need to protect the security and integrity of One Degree Health and the LifeBuddi Mobile Application and Website. We need your help in order to do this. So, you agree that:
(a) if you are a Participant, or place any Purchase Orders you will comply with all applicable laws in doing so;
(b) you will comply with all applicable laws in relation to your access to and use of the LifeBuddi Mobile Application and Website (including but not limited to duties and obligations of confidentiality and privacy);
(c) you will not send or otherwise post unauthorized commercial communications to users (such as spam) through One Degree Health or the LifeBuddi Mobile Application and Website;
(d) you will not directly promote or advertise any goods or services through One Degree Health or the LifeBuddi Mobile Application and Website without our consent;
(e) you will not use One Degree Health or the LifeBuddi Mobile Application and Website to do anything unlawful, misleading, malicious, or discriminatory;
(f) you will not use One Degree Health or the LifeBuddi Mobile Application and Website in a way, or post to or make available via One Degree Health or the LifeBuddi Mobile Application and Website any material, which interferes with other users or defames, intimidates, harasses, threatens, menaces or offends any person or which inhibits any other user from using or enjoying One Degree Health or the LifeBuddi Mobile Application and Website or which is indecent, violent, inflammatory or pornographic material or material in any way offensive that could give rise to civil or criminal proceedings;
(g) you will not solicit or collect other peoples information through One Degree Health or the LifeBuddi Mobile Application and Website, or otherwise access the LifeBuddi Mobile Application and Website using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission;
(h) you will not tamper with, hinder the operation of, or make unauthorized modifications to the LifeBuddi Mobile Application and Website;
(i) you will not knowingly transmit any virus or other disabling feature to or via One Degree Health or the LifeBuddi Mobile Application and Website;
(j) you will not frame or mirror or link to any part of the LifeBuddi Mobile Application and Website without our prior written consent;
(k) you will not post content or take any action on the LifeBuddi Mobile Application and Website that infringes someone else’s rights;
(l) if you collect information from others through One Degree Health or the LifeBuddi Mobile Application and Website you will obtain their consent, make it clear you (and not us) are the one collecting their information, and only use or disclose the information in accordance with all relevant laws and the Privacy Policy; and
(m) you will not attempt any of the above acts or permit another person to do any of the above acts.

42. You are solely responsible for Your Content that you provide to or make available on the LifeBuddi Mobile Application and Website.

43. You must immediately notify us if you become aware or have a reason to believe any other Participant or Website User is doing any of the acts in section 42 above.

Specific terms for Participants

44. We need your help to protect your security as a Participant. You therefore agree to do the following:
(a) you will not provide any false personal information to One Degree Health or on the LifeBuddi Mobile Application and Website, or create an account for anyone other than yourself without permission;
(b) you will notify us immediately if the security of your account has been compromised or if your identification details for your account become known by a third party; and
(c) you will not share your password, let anyone else access your account, or do anything else that might jeopardize the security of your account.

About Advertisements on the One Degree Health Website

45. Our goal is to provide third party advertising and links to beneficiaries or others that may be valuable or interesting to you. The One Degree Health Website, LifeBuddi Mobile Application and Website may contain links to websites owned, operated or hosted by third parties (Linked Websites). Links to Linked Websites are provided for convenience only and may not remain current or be maintained.

46. Links to Linked Websites, and the advertisement of any third parties, should not be construed as any endorsement, approval, recommendation, or preference by One Degree Health of them or their goods/services. To the extent permitted by law, we take no responsibility and have no liability in relation to them and your use or reliance on these is at your own risk.

47. We may receive sponsorship, fees and/or commissions from third parties in connection with Linked Websites or third party advertising. You acknowledge and consent to us receiving the sponsorship, fees and/or commissions.

What we can do if you do not comply with Our Agreement

48. We take your obligations very seriously, so if we believe you have violated Our Agreement, or otherwise create possible legal exposure for us, we can:
(a) stop providing the LifeBuddi Mobile Application and Website to you (including preventing you from placing a Purchase Order);
(b) remove (including destroy) any of Your Content;
(c) suspend, disable or terminate your account with One Degree Health, the LifeBuddi Mobile Application and Website (if you are a Participant); and/or
(d) terminate Our Agreement.

We can undertake these acts immediately. We will endeavour to notify you as soon as possible.

49. If, after receiving our notice, you believe we undertook any acts under clause 42 by mistake, we will take reasonably efforts to give you an opportunity to provide us with an explanation or reason as to why and we will consider your explanation or reason.

Other ways for termination of Our Agreement

50. We may terminate Our Agreement, your account with LifeBuddi (if you are a Participant) or end your access to or use of the LifeBuddi Mobile Application and Website (including preventing you from placing a Purchase Order) at any time without any reason on reasonable notice to you.

51. You may terminate Our Agreement and, if you are a Participant, your account with One Degree Health or LifeBuddi at any time without any reason by notice to us. If you have made a Purchase Order, your ability to termination such purchase order is subject to the Payment Terms.

52. Sections 18 to 22, 23 to 27, 31 to 37, 45, 46 and 52 to 77 still apply after termination of your account and/or Our Agreement:

53. We use 256 bit SSL encryption technologies and use reasonable efforts to protect the privacy of the information you provide to us. To the extent we hold such information, we encrypt all email addresses, passwords and other contact details of the Participants or people who make Purchase Orders.

54. We try to keep the LifeBuddi Mobile Application and Website up, bug-free, and safe and secure, but you use it at your own risk.

55. We may not at all times control or monitor the truth, accuracy, completeness, safety, timeliness, quality, appropriateness, legality or applicability any content, information or communications by Participants or Website Users via One Degree Health or the LifeBuddi Mobile Application and Website. You use and rely on any such content, information or communications at your own risk

56. You must provide at your own expense, all hardware, software or any other equipment necessary to access the Internet or otherwise enable you to be a part of One Degree Health as a Participant or access or use the LifeBuddi Mobile Application and Website. The ability for you to be a part of One Degree Health as a Participant or access or use the LifeBuddi Mobile Application and Website will be dependent on your hardware, software and network infrastructure as well as shared infrastructure of the Internet and our security processes.

57. The Internet is sometimes unreliable and is a difficult medium to secure. We cannot guarantee the security of One Degree Health or the LifeBuddi Mobile Application and Website or the systems (including the Internet and your hardware and software) used to access the LifeBuddi Mobile Application and Website, or any information that passes through such systems. However, we do agree to use all reasonable endeavours to do ensure the security of One Degree Health or the LifeBuddi Mobile Application and Website.

58. To the extent permitted by law, we are not responsible for any unauthorised access to your personal information or loss of or corruption of data caused by any third party or via any third party system.

59. We may need from time to time to make the LifeBuddi Mobile Application and Website unavailable and/or withdraw or limit access to the LifeBuddi Mobile Application and Website in order to effect any changes to, or remedy any faults in, the LifeBuddi Mobile Application and Website.

We limit our liability to you

60. You acknowledge that we charge a minimal fee for you to use the LifeBuddi Mobile Application and Website. Accordingly, our liability in connection is substantially excluded or limited.

61. We are providing LifeBuddi Mobile Application and Website “as is” without any express or implied warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

62. We cannot guarantee that LifeBuddi Mobile Application and Website will be safe or secure.

63. We are not responsible for the actions or content of third parties, and you release us, our directors, officers, employees, and agents from any claims and damages, known and unknown, arising out of or in any way connected with any claim you have against any such third parties. This includes that we provide no warranties and have no liability in connection with:
(a) your relationship with third parties regarding your participation in relation to the LifeBuddi Mobile Application and Website;
(b) any loss or unauthorised access or use of Your Content, your information or account by a third party; or
(c) the use or misuse of the LifeBuddi Mobile Application and Website by a third party.

64. To the extent permitted by applicable law, we exclude all warranties and conditions that may otherwise be implied into Our Agreement.

65. To the extent permitted by applicable law, we are not responsible for and have no liability in relation to:
(a) loss caused by factors which could reasonably be considered to be outside our control such as faults in third party equipment; or
(b) personal injury;
(c) death;
(d) loss of data, loss of profits, loss of revenue, loss of opportunity, special, incidental or consequential loss, whether suffered by you or any other party and however so arising, including claims based in contract (including for repudiation), tort (including negligence), common law, equity, statute or otherwise whether in relation to your access to and use of the LifeBuddi Mobile Application and Website, your participation in LifeBuddi Mobile Application and Website, your purchases on the LifeBuddi Mobile Application and Website or otherwise.

66. We are not responsible for and have no liability in relation to any loss to the extent that it is caused by you, for example, through your negligence or breach of contract.

67. If, subject to what is set out in this “We limit our liability to you” section, we are liable, you agree that we are only liable up to the sum of AUD$100.

68. You must take reasonable steps to minimize the extent of the loss you may suffer for which we may be liable. You must notify us in writing of your loss as soon as is reasonably possible.

Your liability to us

69. You must indemnify, defend and hold harmless us, our officers, employees, and agents from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from:
(a) your breach of Our Agreement;
(b) Your Content;
(c) your infringement, of any intellectual property or other
right of any person (including by Your Content);
(d) your acts or omission as a Participant; or
(e) your access to and use of the LifeBuddi Mobile Application and Website.

Other contract terms

70. Our Agreement is governed by the law in force in the State of New South Wales, Australia, and the parties irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.

71. Our Agreement makes up the entire agreement between Participants and Application and Website Users and us and supersedes any prior agreements.

72. If any portion of Our Agreement is found to be unenforceable, the remaining portion will remain in full force and effect.

73. If we fail to enforce any of Our Agreement, it will not be considered a waiver.

74. You will not transfer any of your rights or obligations under Our Agreement to anyone else without our consent.

75. All of our rights and obligations under Our Agreement are freely assignable by us.

Definitions

76. By “the LifeBuddi Mobile Application and Website” we mean the features and services we make available, including through our application and website at and any other One Degree Health or LifeBuddi branded Application or Website or co-branded websites (including sub-domains, international versions, and mobile versions).

77. By “LifeBuddi” we mean the service of a mobile application and website where an individual can endeavour to improve their personal state of health and wellbeing, interact with others around health and wellbeing, and seek related health-services and health-support services.

78. By “content” we mean the content and information you provide to One Degree Health or post on or make available to the LifeBuddi Mobile Application and Website, including information about you and the actions you take, any photos, video, or text or other forms of content.

Payment Terms

79. You may make payments to One Degree Health Limited (“us”) through the LifeBuddi Mobile Application and Website.

80. By placing an order for any products or services through the LifeBuddi Mobile Application or Website, you agree that you have read, understand and agree to be bound by these terms and conditions in effect at the time of purchase (Payment Terms).

81. These Payment Terms are subject to change without prior written notice at any time and such changes shall apply to any purchase orders made after such changes are posted to the One Degree Health Website. The Terms and Conditions may also be amended from time to time. Therefore, you should review these Payment Terms and the Terms and Conditions prior to making each purchase order or donation so you will understand the terms applicable to your transaction.

82. If you do not agree to these Payment Terms or Terms and Conditions, do not place any purchases orders on the LifeBuddi Mobile Application or Website.

83. To place a purchase order on the LifeBuddi Mobile Application or Website, you must:
(a) be over 15 or have the consent of your parent or guardian;

(b) comply with these Payment Terms (and the Terms and Conditions);

(c) have a current email address; and

(d) have a valid credit card or PayPal account which you are authorised to use for making the donation or placing the purchase order by under these Payment Terms and other Terms and Conditions.

84. You agree to accept responsibility for all purchase orders made by you by someone on your behalf.

85. All payments which you make to One Degree Health through the LifeBuddi Mobile Application or Website are made through:

(a) a separate credit card transaction gateway, the Braintree Payment System (Braintree Payment System) (https://www.braintreepayments.com); or

(b) a separate transaction gateway, the PayPal Payment System (PayPal Payment System)

These gateways are not operated by us. The Braintree gateway is operated by a third party provider called Braintree (https://www.braintreepayments.com) and PayPal (http://www.paypal.com.au). Transactions through this gateway are processed and settled by ANZ. The PayPal gateway is operated by a third party provider called PayPal (http://www.paypal.com.au). Transactions through this gateway are processed and settled by PayPal.

86. The Braintree Payment System accepts Visa, Mastercard and American Express credit cards as forms of payment. The PayPal Payment System accepts various forms of payment.

87. By submitting a purchase through the Braintree Payment System, you authorize ANZ to charge the account you specify for the purchase amount. By submitting a purchase through the PayPal Payment System, you authorize PayPal to charge the account you specify for the donation or purchase amount.

88. All payments are to be made in Australian Dollars.

89. You must not pay, or attempt to pay, for products or services in relation to One Degree Health through any fraudulent means.

90. Please see the Privacy section below regarding how we deal with your credit card number and other personal information.

91. You agree that we may contact you or the recipient of a product or service under a purchase order (the Recipient) in relation to your purchases through the LifeBuddi Mobile Application or Website. You provide us with all necessary consents for these purposes. You acknowledge that our main form of communication with you will be by email or through the LifeBuddi Mobile Application or Website.

92. You agree that ANZ, Braintree, and PayPal may contact you or the credit card holder or account holder in relation to your donations or purchases through the LifeBuddi Mobile Application or Website. Otherwise you acknowledge that our main form of communication with you will be by email or through the LifeBuddi Mobile Application or Website.

93. You may opt-in to certain communications from us or third parties. If you do so, we or third parties may communicate with you in accordance with your opt-in unless you notify us otherwise.

94. If you order products or services, through the LifeBuddi Mobile Application or Website we may require you to confirm details (including contact details) and to provide further information needed by us or ANZ or PayPal to facilitate the processing of any donations or payments that you make. You agree to provide us with current, complete and accurate details when asked to do so for this purpose.

95. Prices of products and services displayed on the LifeBuddi Mobile Application or Website are current at the time of issue, but are subject to change without notice. You should check the price of a product or service at the time of placing an order for it.

96. Any order placed by you through the LifeBuddi Mobile Application or Website for a product or service is an offer by you to purchase the particular product or service for the price notified (including the delivery and other charges and taxes) at the time you place your order.

97. We reserve the right to accept or reject your offer for any reason, including, without limitation, the unavailability of any product or service, an error in the price or the product description posted on the LifeBuddi Mobile Application or Website, or an error in your order.

98. We will email you an order confirmation for the sole purpose of confirming the details of your offer. Please note that our order confirmation does not constitute an acceptance of your offer or reflect the status of your order in any way.

99. Orders will not be accepted and products will not be despatched or service arranged until payment in full has been received and we are satisfied with the integrity of the order and the validity of payment. We will send you a payment and delivery confirmation at that time. We reserve the right to cancel an order after a payment and delivery confirmation at that time if payment could not be completed.

100. Please note that reference to any products, services, processes or other information, by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof, or any affiliation, by us.

101. (a) LifeBuddi account holders may access the Products in two ways:
(i) Free Trial: a free-of-charge program, which gives unlimited access to seven days of LifeBuddi with restricted access to the Foundation audio series.
(ii) (ii) Paid Subscription: a subscription fee-based program, which gives access to all content including and beyond the Free Trial. You may have access to a free trial period of the subscription program in accordance with certain promotional offers. All subscription services provide access through the Products. You can become a subscriber by purchasing a subscription to the Products from the Website, or within the App. Please note that if you purchase a subscription through the Apple iTunes Store or our iPhone application, the sale is final, and we will not provide a refund. Your purchase will be subject to Apple’s applicable payment policy, which also may not provide for refunds. If you purchase a subscription through the Google Play store, the sale is final and we will not provide a refund. Your purchase will be subject to Google’s applicable payment policy, which also may not provide for refunds.
(b) LifeBuddi offers monthly and annual subscription options. A month constitutes 30 calendar days, a year constitutes 365 calendar days.
(c) If you subscribe during the free trial period, any unused portion of the free trial will be forfeited.
(d) Our “Monthly” subscription is paid in monthly installments. For each month that your monthly subscription is active, you acknowledge and agree that LifeBuddi is authorized to charge the same credit card as was used for the initial subscription fee or other payment method in the amount of the then current monthly subscription fee. The monthly renewal subscription fees will continue to be billed to the Payment Method you provided, automatically until cancelled. You must cancel your subscription before it renews each month in order to avoid billing of the next month’s subscription fee to the Payment Method you provided. Refunds cannot be claimed for any partial-month subscription period.
(e) Our “Yearly” subscription is paid for by an upfront one-off payment with automatic annual renewals. You acknowledge and agree that LifeBuddi is authorized to charge the Payment Method used for (i) the initial annual subscription fee at the rate secured at the time of purchase, and (ii) the renewal subscription fee(s) at the effective rate in effect at the time of any such renewal. You must cancel your subscription before it renews in order to avoid billing of the renewal subscription fee to the Payment Method you provided. Refunds cannot be claimed for any partial subscription period.
(f) You may cancel automatic renewals of your subscription at any time by emailing support@lifebuddi.com. Please note that if you purchase a subscription through the Apple iTunes Store or our iPhone application, you may cancel automatic renewals by selecting Manage App Subscriptions in your iTunes Account settings and selecting the subscription you want to modify. If you purchase a subscription through the Google Play store you may cancel automatic renewals in account settings under Subscriptions in the Google Play app, or according to the current process outlined by Google Play.
(g) You agree to promptly notify LifeBuddi of any changes to the Payment Method you provided while any subscriptions remain outstanding. You are responsible for all applicable fees and charges incurred, including applicable taxes, and all subscriptions purchased by you.
(h) In the course of your use of the Products, LifeBuddi and its third party payment service provider may receive and implement updated credit card information from your credit card issuer in order to prevent your subscription from being interrupted by an outdated or invalid card. This disbursement of the updated credit card information is provided to LifeBuddi and LifeBuddi’s third party payment service provider at the sole election of your credit card issuer. Your credit card issuer may give you the right to opt-out of the update service. Should you desire to do so, please contact your credit card issuer.
(i) Our obligation to provide the Products only comes into being when we take receipt of your Order. Prices in AUS Dollars include local taxes. You agree not to hold us responsible for banking charges incurred due to payments on your account. If payment is not received by us from the Payment Method you provided, you agree to pay all amounts due upon demand by us. You agree that you are not permitted to resell any Products purchased through LifeBuddi for commercial purposes.

102. Cancellation By You
(a) You may cancel a Monthly subscription at any time. Cancellation is effective at the end of the applicable monthly or annual period. Please make any such cancellation by emailing support@LifeBuddi.com.
(b) Please note that if you purchase a subscription through the Apple iTunes Store or our iPhone application, you may cancel your subscription by cancelling automatic renewal of paid In App Subscriptions by selecting Manage App Subscriptions in your iTunes Account settings and selecting the subscription you want to modify. If you purchase a subscription through the Google Play store you may cancel automatic renewals in account settings under Subscriptions in the Google Play app, or according to the current process outlined by Google Play.

103. We may suspend or terminate your use of the Products as a result of your fraud or breach of any obligation under these Terms. Such termination or suspension may be immediate and without notice. A breach of these Terms, includes without limitation, the unauthorized copying or download of our audio or video content from the Products.

104. You must provide us with a current email address and where applicable a Recipient.

105. All receipts and most intangible or paper-based products and services will generally be delivered through email only. Any other products will be delivered in accordance with our Delivery Policy.

106. You consent to us sending receipts and, where applicable, products to the email address(es) you provide to us.

107. As between you and us, we will retain title to the products you order through the LifeBuddi Mobile Application or Website until the latter of your making payment in full for those products and delivery of the products to you, but all risk in the products will pass to you upon their delivery to you.

108. You are responsible for any applicable sales or use tax, duties, or other governmental taxes or fees payable in connection with your purchase.

109. We do not guarantee that you will be eligible for any tax benefit by purchasing a product or service from us except to the extent that we currently hold an endorsement for deductible gift status.

110. If GST is imposed on any supply of a product or services through the LifeBuddi Mobile Application or Website, you must pay to us, in addition to any consideration payable or to be provided by you for this supply, an additional amount for the supply calculated by multiplying the prevailing GST rate by the consideration for the relevant supply payable or to be provided (without any deduction or set off) by you. Any amount payable by you is payable on demand by us, whether such demand is made by an invoice or otherwise.
